Paul Miller is a partner at Howie, Sacks & Henry LLP and an experienced personal injury lawyer in Toronto with 25 years of practice focused on mass torts and class actions. Paul’s practice is devoted to mass tort and class action litigation, defective medical device and product liability claims, airplane accident litigation, slip and fall claims, long-term disability disputes, and motor vehicle accidents. Over his career, he has been nominated twice for Canadian Lawyer Magazine’s Top 25 Most Influential Lawyers, recognized in Best Lawyers® in Canada for Product Liability Litigation, and certified by the Law Society of Ontario as a Specialist in Civil Litigation. He is also a board director of Public Justice, a prominent US-based public interest legal organization – a rare distinction for a Canadian lawyer.
Paul believes that access to the courts is fundamental, that when people are devastated by serious injuries, they deserve not only financial compensation but the right to seek justice through the legal system. That conviction has driven him to take on cases that other lawyers would not, including landmark public interest and governmental accountability matters that have reshaped the legal landscape for injured Canadians.
Canada’s Leading Airplane Accident and International Litigation Lawyer
Paul has served as lead or co-counsel in some of the most significant airplane accident and international mass tort cases in Canadian history. He was lead counsel for the trial team in the Ukrainian International Airlines Flight 752 plane crash litigation, which resulted in a landmark Ontario Court of Appeal ruling on airline liability in conflict zones. He served as co-lead counsel representing victims of the August 2, 2005 Air France crash at Toronto Pearson Airport – a case that resulted in a settlement in excess of $20 million. He has also litigated the Fly Jamaica Flight OJ 256 Class Action and the MK Airlines Halifax Plane Crash, and is currently advancing claims arising from the Ethiopian Airlines crash.
Beyond aviation, Paul’s international litigation work has included representing 23 Canadians in litigation related to the events of September 11, 2001; serving as co-counsel for Canadian diplomats in Cuba affected by Havana Syndrome; representing Canadian veterans harmed by the anti-malarial drug Mefloquine; and serving as co-counsel for the Province of British Columbia in its class action against opioid drug companies. He also acted as co-counsel for Pikangikum First Nation’s $2 billion lawsuit against the Federal Government arising from a prolonged water crisis.
25 Years of Landmark Mass Tort Results
Paul’s product liability and mass tort work spans some of the most significant defective device and medical product litigation in Canada, including Essure permanent birth control (Bayer), the Allergan breast implant recall, hernia mesh complications, St. Jude defibrillator and pacemaker defects, talcum powder and ovarian cancer claims, asbestos and mesothelioma cancer claims, and the Dr. Martin Jugenburg (Dr. 6ix) cosmetic clinic class action. In 2024, Paul and co-counsel secured a $22.5 million judgment for patients harmed at the Toronto Cosmetic Clinic — one of the most significant medical negligence class action results in recent Ontario history.
